1. Who is included in this case?
This case is a class action, which means that the plaintiff is seeking to bring this case on her own behalf as well as on behalf of a class of all other persons with similar claims. In this case, under the settlement, the “Settlement Class” is defined as each person who purchased a complete pair of prescription eyeglasses for a child age 12 and under at a LensCrafters store in the United States between January 1, 2005 and July 20, 2008 (a "Qualifying Purchase"), except for current and former employees of LensCrafters, their family members, and anyone else who purchased their children’s eyeglasses using the LensCrafters’ employee discount.
2. Who represents the Settlement Class?
The Court has appointed the law firm of DiTommaso Lubin, 17W 220 22nd Street, Suite 200, Oakbrook Terrace, IL 60181, to represent the Settlement Class (“Class Counsel”). Class Counsel’s fees and expenses will be paid by LensCrafters under the settlement. You also have the right to retain counsel at your own expense to advise you as to your rights under the settlement.
3. What does the settlement provide?
Under the settlement, each Settlement Class member is entitled to receive one $15 voucher (a “Settlement Voucher”) for each Qualifying Purchase he or she made. Settlement Class members must request their Settlement Vouchers from the Settlement Administrator. The deadline to request a Settlement Voucher has passed.
4. What are the terms and conditions of the Settlement Vouchers?
Settlement Vouchers may be used towards the purchase of any merchandise at any LensCrafters store in the United States. Settlement Vouchers are not redeemable for cash, and may be used only once. Settlement Vouchers may be used in combination with other offers or discounts notwithstanding any restrictions in the terms of those other offers or discounts prohibiting combination with other offers or discounts, provided however that Settlement Vouchers may not be used in combination with other vouchers or other credits LensCrafters or its affiliates may issue in connection with settlements in other actions. Settlement Vouchers may be used in combination with other Settlement Vouchers up to a maximum of three Settlement Vouchers in a single transaction. Settlement Vouchers may be transferred subject to the following conditions: (i) A transferee within the same household as the transferor may use up to three Settlement Vouchers in combination in a single transaction; (ii) A transferee not within the same household as the transferor may not use more than one Settlement Voucher in a single transaction. Settlement Vouchers shall expire eight (8) months after their date of issuance.
